Terms and conditions
These terms apply to every quotation and every assignment unless we agree otherwise in writing. What your quotation says always takes precedence over this page.
Who we are
EMSwise is a trading name of I7C BV, Hertstokweg 5, 1741 Ternat, Belgium, company and VAT number BE 0476.607.718.
Quotations and the energy study
A quotation is valid for thirty days unless it states otherwise. Equipment prices may change if our supplier changes them; we tell you before we order.
The energy study is a standalone product with its own price. You are committed to nothing afterwards: the report is yours and remains usable with another installer. If you award us the work, the study is set off against the assignment.
Prices and payment
Prices are in euro. The applicable VAT rate is stated on the quotation; which rate applies depends on your situation and on the rules in force at the time.
Unless agreed otherwise, thirty per cent is paid on order and the balance within fourteen days of handover. Late payment carries statutory interest; for businesses, the statutory provisions on late payment apply in addition.
Execution, lead times and what we need from you
Stated lead times are a good-faith estimate, not a guaranteed outcome: equipment delivery and the inspection body’s diary are not within our control. If something slips, we tell you as soon as we know.
You provide a safe and accessible site, power, and access at the agreed times. If the existing installation falls short of what could reasonably be expected, we discuss the additional work before carrying it out.
Inspection and registration
A permanently installed battery must pass inspection before use and is then registered with the grid operator. We request the inspection and file the registration, but the inspector is an independent accredited body: we cannot guarantee the outcome. A failure caused by something attributable to us is put right at our cost.
Warranty
For consumers, the statutory two-year conformity warranty applies. On top of that comes the manufacturer’s warranty on battery, inverter and accessories, for the term and under the conditions of that manufacturer; these are in your file.
The warranty does not cover damage caused by third-party intervention in the installation or the control layer, by use outside the prescribed limits, or by causes outside the installation such as lightning or grid disturbances.
Liability
We are liable for damage caused by a fault in our work. That liability is limited to the amount of the assignment concerned, or to what our insurance pays out in that case if that is more.
We are not liable for indirect loss such as lost profit, nor for outcomes driven by an energy price, a tariff or a subsidy scheme that turns out differently from what a study estimated. A study is a reasoned estimate, not a guaranteed result. These limitations do not apply in case of intent, gross negligence or personal injury.
Withdrawal, complaints and disputes
If you conclude a contract as a consumer away from our premises, you have fourteen days to withdraw. If you expressly ask us to start within that period and the work has been carried out, that right lapses; it does not apply to equipment adapted to your situation.
A complaint about the work should reach us in writing within eight days of discovery, so that we can look into it. Failing agreement, Belgian law applies and the courts of the Brussels district have jurisdiction. Consumers may also turn to the Belgian Consumer Mediation Service or the European ODR platform.
